Villa Maba is located in the Sarıbelen neighborhood of Kaş. Our very special and new villa for rent is luxurious and conservatively built. Our villa has a large garden and allows you to have a comfortable holiday. Our villa is in a great location where you can spend time in a secluded, quiet and sheltered way. Our villa is not suitable for accommodation without a car. Our villa, which has a luxurious interior design, is a suitable option for both honeymoon couples and nuclear families.

RENTAL AGREEMENT PARTIES AND PURPOSE

This contract has been made between the tenant (hereinafter referred to as the "TENANT") who rents the "VILLA/VACATION HOME" and Likya Transportation Tourism Ltd. Co. (hereinafter referred to as "VILLANIZBURADA") for a specified period of time determined in advance by the parties for the purpose of renting the "VILLA/VACATION HOME." Renters who book any of our villas/vacation homes from our website "www.Villanizburada.com" or by phone or email are deemed to have accepted the following terms and conditions. In the event of any violation of the conditions stated below, "VILLANIZBURADA" reserves the right to unilaterally cancel the rental, request the tenant to vacate the villa/vacation home, retain the deposit rental fee, and demand payment of all unpaid rental fees.

RESERVATION AND PAYMENT

Our villas/holiday homes, which are marketed by us, can be reserved through the reservation form on our website, by phone, or by email. VILLANIZBURADA will make your rental after you specify the dates you want to rent and provide us with the necessary transportation and billing information. After the rental process is completed, VILLANIZBURADA collects 30% of the total amount as a deposit payment for the villa/holiday home. The deposit will be reserved in your name if it is paid within 1 (one) business day after the rental is made. The amount of the deposit to be paid and our bank account numbers will be provided to you by email, SMS, or by phone. After receiving the payment, VILLANIZBURADA reserves the right to unilaterally terminate the contract within 1 (one) business day. The deposit can be paid by wire transfer, EFT, and credit card via the website. Within 1 business day of receiving the deposit, written confirmation of the rental of the villa/holiday home will be sent to you. The total cost, the deposit received, the dates the villa/holiday home is rented in your name, and the day and time of your deposit payment will be provided during the rental. If the deposit is not paid within 1 business day, VILLANIZBURADA may cancel the pre-reservation without informing the tenant and may make another reservation for the villa/holiday home. The remaining rental fee for the villa/holiday home will be paid in cash upon delivery of the villa/holiday home, after the contract is signed, and the villa/holiday home is checked. Furthermore, VILLANIZBURADA takes a damage deposit of 500 TL/2000 TL due to the furnished delivery of the rental, and this deposit is paid in cash upon delivery of the villa/holiday home. The damage deposit will be refunded to the tenant if there is no shortage in the inventory after the tenant's departure. To prevent any inconvenience that may arise from the above reasons, it is strongly recommended to have these amounts ready in cash on the day of entering the villa/holiday home.

ENTRY AND EXIT TIMES FOR THE VILLA/HOLIDAY HOME

The check-in time for the villa/holiday home on the start date of the reservation is at the earliest 16:00 and at the latest 21:00. The tenant cannot check into the villa/holiday home outside the specified hours, and if the tenant arrives after the latest check-in time, the tenant can check in the villa/holiday home the next morning at the beginning of VILLANIZBURADA's business hours (09:00). VILLANIZBURADA is in no way responsible for any problems caused by the tenant's inability to check into the villa/holiday home before the specified time or after the specified time, including overnight accommodation, finding accommodation, and other problems. In case the tenant wants to check out early, VILLANIZBURADA must be informed at least 24 hours in advance. Due to high demand, if the tenant leaves the villa/holiday home before the specified time or later than the specified time, the tenant is solely responsible for all negative consequences, damages, losses, etc., and is obliged to cover all financial losses of VILLANIZBURADA that may arise from these negative situations. We strongly recommend planning travel accordingly to avoid inconveniences for both parties. In cases where early check-out is desired, VILLANIZBURADA must be informed 24 hours in advance. In case the villa/holiday home is vacated before the specified time or late, the tenant's damage deposit will be sent to the bank account specified by the tenant after counting the fixed assets. In the event of the tenant voluntarily leaving the villa/holiday home early, no refund will be made for the accommodation fee.

VILLA / SUMMER HOUSE CAPACITY

Absolutely no more guests than the capacity specified on our website for our villas/summer houses or more than the number of people specified when making the reservation (including children and babies) are accepted. If changes in the number of people are desired after the rental is confirmed, the tenant must apply to VILLANIZBURADA in writing, and this change can be approved by VILLANIZBURADA depending on the capacity of the villa/summer house. VILLANIZBURADA may request an additional fee from the tenant. After check-in to the villa/summer house, no guests other than those specified in the reservation list are accepted. In cases where this is detected, VILLANIZBURADA has the right to request that the guests leave the villa/summer house, cancel the reservation completely, or request that the villa/summer house be vacated before the end of the rental period, and demand the full fee and extra charges. At the rental stage of the villa, transactions are carried out in accordance with the tenant's statement, and the tenant accepts that the information provided is correct and complete and assumes all responsibilities in this regard.

VILLA / SUMMER HOUSE CLEANING / MAINTENANCE AND ADDITIONAL EXPENSES

Entry cleaning is included in the daily, weekly, and monthly villa/summer house rental prices. For stays of 2 (two) weeks or more, weekly cleaning and towel/bedsheet changes are included in the prices. Any other cleaning and towel/bedsheet changes requested are subject to additional charges. For stays shorter than the minimum rental period specified, an extra short-term stay fee may be added to the total amount. This fee may vary depending on the villa and is displayed in the prices section on our website. Pool and garden maintenance is carried out early in the morning, and if any technical issues arise during the rental period, they will be resolved by the homeowner. The homeowner is responsible for any issues related to pool and garden maintenance. VILLANIZBURADA acts only as an intermediary in the rental process and is not responsible for any issues that may arise, only assisting in resolving them. In order to perform periodic maintenance of the pool, garden, and other fixtures of all villas/summer houses, it is necessary for the assigned personnel to enter the villa/summer house's garden or interior. To ensure that these services are carried out without interruption, the tenant must allow the personnel to enter the villa/summer house when necessary. Unless stated otherwise on our website's villa/summer house details page, electricity, water, gas cylinder, pool lighting, internet connection, and air conditioning usage are included in the prices. Pool lighting, air conditioning, and internet may not be available as standard in all our villas/summer houses, so it is recommended to carefully read the villa/summer house features of the villa/summer house you rented.

PETS/SMOKING

Unless otherwise stated, pets are strictly not allowed in our villas/summer houses. Smoking is not allowed indoors in all of our villas/summer houses.

PRICES

The villa/summer house rental fees specified on our website are daily, weekly, and monthly. The deposit can be made to our bank accounts via wire transfer, EFT, or the Credit Card payment system.

RENTAL / PAYMENT / CANCELLATION TERMS AND REFUND CONDITIONS

The deposit amount of the villa/summer house rental fee paid to our account (by wire transfer or EFT or Credit Card payment system, "single payment," or in advance, or by Mail Order) from the moment you make the payment until 30 days before the date of entry to the villa/summer house, even in case of cancellations, will not be refunded because the full amount of this payment has been made as a deposit to the villa/summer house owner. The remaining amount must be paid to us in cash upon entry to the villa/summer house. The tenant may cancel their trip before the trip starts. The tenant's cancellation notice must be made in writing to VILLANIZBURADA, and notices not made in writing will not be accepted. In case of cancellations, VILLANIZBURADA will collect certain percentages from the customer on the total amounts of the services specified in the travel agreement to cover the measures and expenses taken related to the trip. These amounts are determined as follows.

The customer can cancel their trip before the trip starts. The customer's cancellation notice must be made in writing to "Villanız Burada," and notices not made in writing will not be accepted.

In case of cancellations, Likya Transportation Tourism Limited Company (Villaniz Burada) will collect certain percentages from the customer on the total amounts of the services specified in the travel agreement to cover the measures and expenses taken related to the trip. These amounts are determined as follows:

Cancellation Conditions:

1) Cancellation can be made with the condition of presenting evidence due to compelling reasons (death, accident, COVID, etc.) 60 days before the entry date to the villa/apartment/flat.

2) If the customer wishes to cancel voluntarily, he/she can request cancellation 90 days before the entry date to the villa/apartment/flat.

3) If the reservation is canceled: within 30 days or less before the entry date to the villa/apartment/flat or if you do not check in to the villa/apartment/flat at all; the total travel fee you paid (advance payment and full amount) will not be refunded to the customer. In addition, in the case of cancellations 30 days before the reservation date, you are deemed to have accepted that you are obliged to pay the full rental fee (the entire villa/apartment/flat rental amount) as explained in Article 3. If the cancellation is made at any time within 90 days from the date of the reservation, 70% (seventy percent) of the amount paid will be refunded to the person who made the reservation by making the payment (by wire transfer, by EFT, in cash, or by credit card in a single installment). The remaining 30% (thirty percent) will be refunded to the account number you will specify. Shipping costs will also be deducted from this money. This is because 70% of this amount (seventy percent) was made as an advance payment to the villa/apartment/flat owner. If a cancellation is made within 90 days, the entire advance payment will be forfeited and not refunded.

5) If a previously made reservation is canceled due to compelling reasons, such as people who will TRAVEL (minimum 15 days before) on the date of the reservation having COVID, travel restrictions or exit bans from the city or country they will come from, etc., hospital or official documents stating that such events have occurred must be sent to us in writing by email, regardless of the day, a reservation will be made in the villa on the reservation date with a date change or canceled and the advance payment will be refunded unconditionally.

6) Since problems not caused by the villa (natural disasters, regional power outages, regional network water interruptions, etc.) are not related to the rental process, our company does not accept any responsibility for such situations. People staying in the villa are deemed to have accepted the responsibility for these kinds of problems themselves.

7) If the owner of the property sells the entire villa/apartment/flat to someone else, the new owner of the villa/apartment/flat has the right to cancel reservations or not accept reservations. In such cases, reservations can be canceled, and the customer will be informed as soon as possible, and different alternatives will be tried to be offered to the customer by presenting similar villas/apartments/flats with information. If the offered alternatives are higher in price than the rented villa/apartment/flat, the customer can make a reservation according to their request by paying the difference.

8) After the customer has rented the villa/apartment/flat he/she likes, on the day of check-in (unless there is a different situation than the images of the villa/apartment/flat on the website) the customer cannot change his/her mind, request another villa, or request a refund of the amount paid. When the reservation process is completed, it is deemed that the villa chosen will be rented.

Due to the refund transactions of payments made with credit cards, financial losses, commission fees, etc. that will be charged by the Republic of Turkey, the bank or banks, from the refunded money, will be deducted from the refunded money.

In case a villa/apartment/flat reservation made by Likya Transportation Tourism Limited Company (Villanız Burada) is canceled for any reason, this situation will be notified to the customer as soon as possible. If there is a similar villa/apartment/flat available in our portfolio for the same dates, it will be offered to the customer. In cases where the customer does not approve and does not fall under the "compelling reasons" clause, the money received will be refunded to the customer.

In addition, for some of our villas/apartments/flats (specified on the villa/apartment/flat internet detail page), the entire payment made, and for our villas/apartments/flats (specified on the villa/apartment/flat internet detail page; villas/apartments/flats for which the entire villa/apartment/flat rental amount must be paid in full within 1-50 days from the reservation date) the entire villa/apartment/flat rental amount is collected from the customer. Even if the reservation is canceled, no fees will be refunded.

If the customer does not make the remaining payment on time, Likya Transportation Tourism Limited Company (Villanız Burada) reserves the right to cancel the reservation, not make a refund of the previously paid fee, and make another reservation for this villa/apartment/flat. Reservation cancellations can be made in writing (by email or registered mail). Reservations made by phone are not valid. Reservation cancellations will be valid from the moment they reach Likya Transportation Tourism Limited Company (Villanız Burada) in writing.

For cases where the villa/apartment/flat is not used, including the termination of the contract, villa/apartment/flat shall be deemed to be delivered as of the reservation approval of this contract, without requiring any notification, villa/apartment/flat shall be deemed to be used by the parties from this date, and the entire villa/apartment/flat rental amount specified in the contract shall become due and payable on the specified delivery date. All legal rights of Likya Transportation Tourism Limited Company (Villanız Burada) in this regard are reserved.
